GENERAL TERMS AND CONDITIONS FOR RENTALS

These rental conditions are an integral part of the contractual agreement between MOTO MAP TRAVEL, S.L (Lessor) and the client (Lessee) regarding the use of the motorcycle. Any clarification, change, or supplement to these terms will only be valid if made in writing.

RENTAL AGREEMENT The object of the contractual agreement with Moto Map Travel is exclusively the temporary transfer of the reserved motorcycle. The lessee must organize and carry out their trip according to their preference and use the motorcycle responsibly. Unless otherwise agreed in writing, all prices include unlimited mileage, insurance as chosen, and VAT.

 

MILEAGE LIMIT

 

For rentals lasting 1 to 6 days, mileage is not unlimited and is limited to 300 km/day. Once this limit is exceeded, the price for additional kilometers will range between €0.30 and €0.40 per kilometer, depending on the model.

 

RESERVATION AND PAYMENT

 

All reservations require a valid VISA or MasterCard credit card. After confirming the service, the rental amount will be charged to the provided credit card, and the agreed amount will be known by both parties. Upon picking up the motorcycle, a deposit of €600 or €1500 (depending on the motorcycle model) will be blocked on the credit card.

 

MINIMUM DURATION

 

The minimum rental duration is 1 day. The stipulated pick-up and return times are at 10:00 am and/or 6:00 pm from Monday to Friday. Outside these hours, additional costs specified in the rental contract will apply.

 

AVAILABILITY GUARANTEE

 

After the reservation payment, the lessee will receive a confirmation via email. This guarantees the availability of the reserved motorcycle. Moto Map Travel reserves the right to replace the chosen rental motorcycle at any time due to unforeseen circumstances. Moto Map Travel will endeavor to ensure that the lessee drives the confirmed motorcycle. Unfortunately, unforeseen and uncontrollable situations sometimes occur, including but not limited to mechanical breakdowns, collision damage, and theft. If Moto Map Travel cannot replace the confirmed motorcycle with an identical or similar one, the customer will be refunded the difference in service cost. This constitutes Moto Map Travel's maximum liability. Even if the motorcycle is returned by the lessee before the rental period has ended, the total amount agreed upon in the contract will be charged.

 

CANCELLATION (TOTAL OR PARTIAL) AND DATE CHANGES

 

If the cancellation (total or partial) by the lessee is made more than 30 days before the rental period, the full amount will be refunded. If made between 30 and 15 days, 50% of the total rental payment will be refunded. No refund will be made if done less than 15 days in advance.

 

The rental date can be changed once. To be valid, the change must be notified at least one working day in advance. The new date must be informed at the time of the change and must be within 12 months from the first day of the original rental. This service carries a 20% surcharge of the total rental cost, always with a minimum of 100 euros.

 

Force Majeure

 

If the rental cannot take place or must be suspended once started due to force majeure beyond the control of Moto Map Travel and the customers, such as natural disasters, prolonged strikes, global health alerts, or war, Moto Map Travel's policy is:

 

  • If the rental has not yet started, Moto Map Travel reserves the right to keep the amount paid by the customer at the time of cancellation and apply it in full as a credit for future rentals.
  • If the rental has started and must be interrupted midway, Moto Map Travel reserves the right to keep the total amount paid by the customer and apply the proportional part of the unused rental days as a credit for future rentals.



LESSEE'S OBLIGATIONS

 

The lessee must use the motorcycle carefully and attentively, respecting the appropriate technical codes to ensure safe driving. The lessee must comply with all legal requirements, particularly all traffic regulations. The lessee is responsible for complying with all traffic laws and regulations and must have a valid passport, travel insurance,

 

Prohibited Actions for the Renter

 

a. European Union driving license, or a valid international driving license for the duration of the stay. The lessee will be responsible for paying all fines or administrative penalties attributable to their use of the motorcycle during the rental period. The lessee is prohibited from: a. Allowing any person not previously authorized in the rental agreement to use the motorcycle.

b. Allowing persons not qualified to drive, without a valid driving license, or in an unsuitable state to drive.

c. Driving the motorcycle themselves without being qualified or without a valid driving license.

d. Using the motorcycle in unsuitable conditions. e. Using the motorcycle for commercial purposes.

Using the motorcycle for commercial purposes.

f. Participating in motorcycle events of any kind, including practices or rehearsals for these events or open track sessions.

g. Using the motorcycle off-road, except as stipulated in the rental agreement.

h. Pawning or selling the motorcycle in whole or in parts, equipment, accessories, and documentation, in any way that infringes on the lessor's property rights or any other rights the lessor has over the motorcycle.

i. Taking the motorcycles to African countries such as Morocco, except as stipulated in the rental agreement.



LESSOR'S OBLIGATIONS AND RESPONSIBILITY

 

The lessor commits to maintaining and delivering the motorcycle in a technically acceptable state to ensure safe driving. The lessee must also receive the vehicle's documents and tools. The lessor must acknowledge and accept existing damages on the motorcycle only if they are recorded on the damage sheet at the time of delivery. If a repair is necessary during the rental period to ensure the motorcycle's proper functioning, the lessee must receive the lessor's explicit permission before making any repairs. Any subsequent claims are excluded unless the damage or loss to the lessee is attributed to significant negligence by the lessor.



LESSEE'S RESPONSIBILITY FOR DAMAGE

 

From the moment of delivery until the return of the motorcycle, the lessee is responsible to the lessor even in the case of the slightest negligence or lack of care in case of disappearance (including loss and confiscation) of the motorcycle and any damage (such as an accident or operational damage, damage resulting from inappropriate use, or damage that reduces the motorcycle's value) that occurs beyond normal use of the motorcycle during the rental period. In case of damage to the rented motorcycle, the lessee will be responsible for the repair costs, determined by an expert report, which the lessee will also pay, and the reduction of the motorcycle's technical and market value based on the chosen insurance deductible. The burden of proof for even the slightest damage lies with the lessee.



REQUIREMENTS IN CASE OF ACCIDENT OR ANY OTHER DAMAGE

 

If damage or loss occurs, as in the case of an accident, the lessee must notify the lessor immediately by phone. Moto Map Travel will charge the customer's provided credit card for the repair amount according to the contracted insurance type. In the event of an accident, it must be immediately reported to the police. Evidence (such as road marks) must be preserved, and persons involved in the accident must be identified. The lessee must do everything necessary to facilitate and contribute to clarifying the sequence of events. ASSISTANCE WITH COURIER SERVICE

 

Moto Map Travel offers to assist clients who request it in contracting a courier service for the shipment of their luggage or packages from our rental points. This courier service is provided by an independent company unrelated to Moto Map Travel.

 

Moto Map Travel only acts as an intermediary between the client and the courier company and is not responsible for delays in delivery, damage, or loss of the shipped material.

 

In case of loss, damage, or delay during the shipping process, the client must file the appropriate claim with the contracted courier company, and Moto Map Travel is free of any liability.



VEHICLE INSURANCE COVERAGE

 

The lessee agrees to assume financial responsibility up to the amount specified for the selected model in case of damage to the motorcycle. The credit card information provided in the contract with Moto Map Travel for the motorcycle rental will be used as a guarantee of payment for the insurance deductible (according to the selected motorcycle model) in the form of a block at the time of motorcycle pick-up. The lessee must specifically know that although the motorcycle is insured, they are fully responsible for all damages and liable for payment in the following cases:

 

a. If any of the requirements stipulated in the "Lessee's Obligations" section are not met.

b. If the lessee leaves the scene of an accident they were involved in.

c. If damage is caused intentionally, deliberately, or due to significant negligence.

d. If the rental period agreed in the contract is exceeded.

The basic insurance included in the rental rate is third-party insurance for the vehicle, including the following:

 

  • Third-party coverage with driver accident and travel assistance.
  • Mandatory civil liability coverage for third parties involved in the event of an accident. Both the vehicles and their drivers and occupants up to €50,000,000 per incident.
  • Driver assistance limited to €900 for medical assistance, with a period of 365 days from the accident date in public health centers in Spain and those private centers agreed upon and published in the BOE by Unespa and the General Directorate of Insurance and Pension Funds.
  • Compensation for the driver's death: €6,000.
  • Compensation for permanent disability: A maximum of €6,000 (depending on the degree of disability).
  • The driver is the only insured occupant of the vehicle.
  • These clauses may become invalid in the following cases:
  • The vehicle driver drives under the influence of alcohol, toxic drugs, narcotics, or psychotropic substances.
  • The driver takes the vehicle to places not authorized by the rental company, such as off-road, forest tracks, or any unpaved road, and circuit. (According to the model of the motorcycle specified in the contract)



MOTORCYCLE RETURN

 

The motorcycle must be returned without any visible external deficiencies. The lessee must return the motorcycle in these conditions at the end of the agreed rental period, at the agreed place and time, with all vehicle documents, accessories, and tools. The lessor is authorized to terminate the rental agreement without notice if there is a significant reason that makes the continuation of the contract unacceptable. These reasons include, in particular, false personal information provided by the lessee or incorrect payment information, as well as serious violations of the agreements stipulated in the rental agreement. In the case of termination of the contract without notice, the motorcycle must be returned immediately, even if the rental period has not yet ended. The lessor's rights to claim damages and compensation are not affected by this situation.



TRAFFIC VIOLATIONS AND TOLL RESPONSIBILITY 

 

The lessee assumes financial responsibility for traffic violations and all toll expenses during the rental period. The management of each violation or fine, as well as any unpaid toll, will incur an administrative cost of €30.

 

CHARGES FOR PICK-UP AND RETURN OUTSIDE BUSINESS HOURS

 

The lessee agrees to a charge of €30 per motorcycle for both pick-up and return outside Moto Map Travel's business hours (weekends, national and local holidays). This charge will be paid directly to the agent who delivers or collects the motorcycle outside Moto Map Travel's business hours. Moto Map Travel's business hours are Monday to Friday from 9:00 am to 1:30 pm and from 3:00 pm to 6:30 pm.

 

INSURANCE

 

Moto Map Travel recommends purchasing adequate travel, health, and accident insurance, as well as travel cancellation insurance. Moto Map offers its clients a VIP insurance that covers both for €25/day.

 

PRINTING AND CALCULATION ERRORS

 

Moto Map Travel reserves the right to correct printing and calculation errors at any time.

 

ILLEGAL USE OF MOTO MAP TRAVEL MATERIAL

 

All material appearing on the Moto Map Travel website, Moto Map Travel's tour manuals, and Moto Map Travel's motorcycle maps/routes are protected by international copyright laws and are the property of Moto Map Travel. They may not be copied, reproduced, distributed, published, displayed, performed, modified, created into derivative works, transmitted, or exploited in any way, nor distributed any part of this content through any network, sold, or offered for sale, or used to build any type of database. Copying or storing any content is expressly prohibited, except as provided above, without the prior written permission of Moto Map Travel.
